DATA PRIVACY, CLIENT CONSENT AND CROSS-BORDER DATA TRANSFER
The Client expressly authorises Axpats LLC (“the Company”) to collect, receive, access, record, organise, store, review, verify, copy, scan, digitise, classify, use, process, update, retrieve, disclose, transmit, transfer, archive and securely dispose of the Client’s Personal Data and supporting documents as necessary for the provision of immigration, visa, residency, citizenship, employment, education, licensing and other related consultancy services requested by the Client.
Personal Data may include, without limitation:
– Passport and travel documents;
– Emirates ID or other national identity documents;
– Birth, marriage, divorce and other civil status certificates;
– Educational qualifications and transcripts;
– Employment records, curriculum vitae and reference letters;
– Financial records, bank statements and proof of funds;
– Tax records where required;
– Police clearance certificates;
– Medical reports and health examination records where required by law;
– Biometric information where required by government authorities;
– Photographs and signatures;
– Contact information;
– Immigration history; and
– Any other document reasonably required for the Client’s application.
The Client acknowledges that Personal Data will be processed solely for legitimate purposes including:
– Assessing eligibility;
– Preparing applications;
– Obtaining legal advice where necessary;
– Verifying documents;
– Translating or authenticating documents;
– Filing immigration, employment or visa applications;
– Communicating with government authorities;
– Communicating with employers, educational institutions or licensing authorities;
– Compliance with legal and regulatory obligations; and
– Providing ongoing immigration consultancy services.
The Client expressly authorises Axpats LLC to disclose, transmit and share Personal Data and supporting documents with:
– Government authorities within and outside the United Arab Emirates;
– Immigration departments;
– Embassies and Consulates;
– Visa Application Centres;
– Foreign Ministries;
– Employers and prospective employers;
– Educational institutions;
– Professional licensing bodies;
– Medical facilities authorised for immigration examinations;
– Police verification agencies;
– Banks where required for immigration purposes;
– Translation and document authentication providers;
– Courier companies;
– Regulated immigration professionals, lawyers and consultants;
– Technology providers and cloud hosting providers;
– Any other organisation reasonably required for processing the Client’s application.
The Client expressly consents to the international transfer of Personal Data outside the United Arab Emirates whenever reasonably necessary for processing the requested services.
Such transfers may include countries whose privacy or data protection laws differ from those of the UAE.
The Client understands that immigration, employment and visa processing frequently require documents to be submitted to foreign governments, employers and authorised third parties located outside the UAE.
The Client acknowledges and agrees that Personal Data may be stored electronically on secure servers and cloud infrastructure located within the United Arab Emirates and, where operationally necessary, in other jurisdictions utilised by authorised technology service providers engaged by Axpats LLC.
Axpats LLC shall implement reasonable administrative, organisational and technical safeguards designed to protect Personal Data against unauthorised access, disclosure, alteration, misuse or loss.
Access to Personal Data shall be restricted to authorised personnel and authorised service providers who require such access for legitimate business purposes.
Axpats LLC may retain Personal Data and supporting documents for the duration necessary to:
– Complete the requested services;
– Meet contractual obligations;
– Comply with applicable legal and regulatory requirements;
– Defend legal claims;
– Maintain professional records and audit requirements.
Upon expiry of the applicable retention period, Personal Data shall be securely deleted, anonymised or destroyed unless continued retention is required by law.
Subject to applicable law, the Client may request:
– Access to Personal Data;
– Correction of inaccurate Personal Data;
– Updating of incomplete Personal Data;
– Restriction of processing where legally applicable;
– Withdrawal of consent where processing is based solely upon consent;
– Deletion of Personal Data where legally permissible.
The Client acknowledges that withdrawal of consent or deletion requests may prevent Axpats LLC from continuing to provide the requested services where such processing is necessary to perform the engagement or comply with legal obligations.
Where required by applicable law, Axpats LLC shall respond to Personal Data breaches in accordance with the UAE Personal Data Protection Law and applicable regulatory requirements.
The Client confirms that:
(a) all Personal Data and documents provided are true, accurate and complete;
(b) the Client has the legal authority to provide all documents submitted;
(c) the Client freely and voluntarily consents to the collection, processing, storage, disclosure and international transfer of Personal Data as described in this Agreement;
(d) the Client understands that refusal to provide necessary Personal Data or withdrawal of required consent may prevent Axpats LLC from providing immigration, employment or related consultancy services; and
(e) the Client has read, understood and agrees to this Data Privacy and Consent Clause and acknowledges the Company’s Privacy Policy.
